Men Cell Delhi: Advocate ने आपका Case बिगाड़ दिया? सिर्फ “Lawyer है” कहकर मामला खत्म नहीं होता
“मैंने तो lawyer को पूरा भरोसा करके documents दिए थे… अब अगर वही कुछ गलत करे तो?”
यह सवाल थोड़ा uncomfortable है, लेकिन real life में कभी-कभी client को अपने opponent से पहले अपने ही legal arrangement की चिंता होने लगती है।
18 September 2026 को Delhi High Court ने Puneet Batra v. Union of India & Ors. में एक interesting issue deal किया। मामला एक advocate के office पर GST Department की search और computer तथा documents की seizure से जुड़ा था।
Advocate ने investigation को challenge करते हुए advocate-client privilege का protection उठाया। लेकिन Delhi High Court ने साफ किया कि privilege important है, पर यह ऐसा blanket shield नहीं है जिससे advocate के अपने conduct की investigation ही रुक जाए। Court ने कहा कि जहाँ prima facie material यह indicate करता हो कि advocate केवल legal adviser की भूमिका से आगे जाकर investigated affairs में involved हो सकता है, वहाँ privilege investigation के लिए absolute barrier नहीं बन सकता.
अब इसे थोड़ा आम आदमी की language में समझिए।
Lawyer के पास आपका document होना और lawyer का उस document से जुड़े किसी alleged wrongdoing में खुद involved होना — दोनों बिल्कुल अलग situations हैं।
पहली situation में client confidentiality का protection relevant हो सकता है। लेकिन दूसरी situation में सिर्फ यह कहना कि “मैं advocate हूँ, मेरे office की कोई चीज नहीं देख सकते” हमेशा sufficient नहीं है.

कब वापस मांगा?
क्या वापस मिला?
किस representation पर आपने कोई financial/legal step लिया?
यही paperwork बाद में बहुत बड़ा difference बना सकता है।

लेकिन दूसरी तरफ एक caution भी उतना ही जरूरी है — हर unsuccessful case का मतलब lawyer ने fraud किया, ऐसा भी नहीं है।
कभी case कमजोर होता है। कभी evidence खराब होता है। कभी limitation problem होती है। कभी client और lawyer की expectations ही अलग होती हैं।
इसलिए पहले file को objectively देखिए। फिर decide कीजिए कि problem professional negligence है, communication failure है, fee dispute है, misconduct है या कोई serious legal issue।
और अगर आपका search है “where can a husband complain against wife?”, तो उसी तरह हर matrimonial problem को blindly criminal complaint में convert करना भी जरूरी नहीं। कभी complaint सही remedy होती है, कभी civil proceeding, कभी professional grievance mechanism और कभी simply better documentation.

यह lawyer के खिलाफ जाने की बात नहीं है। यह अपने ही case की जिम्मेदारी समझने की बात है।
क्योंकि जब matter करोड़ों की property, business, marriage, reputation या criminal proceedings से जुड़ा हो, तब बाद में यह कहना कि “मुझे तो पता ही नहीं था कि file में क्या चल रहा है” बहुत महंगा पड़ सकता है।
और अगर आपको अभी लग रहा है कि आपके lawyer के handling में कुछ serious गड़बड़ है, तो अगली hearing या अगला नुकसान होने तक wait मत कीजिए। पहले अपनी पूरी file, payment trail और communication सुरक्षित करिए।
आज documents की एक proper copy बनाना boring लग सकता है। कल वही copy आपकी सबसे important protection बन सकती है।

Case-specific caution: Puneet Batra v. Union of India & Ors. का ruling अपने particular investigation और prima facie material से जुड़ा है। यह यह नहीं कहता कि advocate के पास मौजूद हर client document investigation में खुला रहेगा, और न ही यह हर lawyer-client dispute को wrongdoing मानता है। Privilege और investigation का balance facts तथा applicable law पर depend करेगा.
